A biostatistician at a contract research organization reviews unblinded interim trial data months before a sponsor’s public readout.

That person is not a sponsor employee. That means they may not be covered by the sponsor’s trading policies.

And they can now buy event contracts on Kalshi pricing the probability of FDA approval for the exact drug they have non-public data on.

Some say this is the pharmaceutical version of the compliance gap the StarCompliance webinar flagged last week.

A CRO employee buying a Kalshi event contract on a clinical trial outcome falls completely outside those controls — even if the underlying information asymmetry is identical to insider trading on the stock.

The fix, according to experts quoted in the piece, starts with rewriting confidentiality language in vendor contracts to explicitly cover prediction market trading. Most pharma companies haven’t done that yet. The biostatistician, the lab technician, the regulatory affairs consultant — anyone with early access to trial or FDA data who isn’t a direct employee — is currently operating in a gap.

The House Oversight Committee has already expanded its insider trading investigation to five platforms. The CFTC probed former Representative Kinzinger for pardon-related trades. A pharma insider trading case on a clinical trial outcome would be the most financially significant case yet — and the compliance infrastructure to prevent it doesn’t exist.
